Compliance Checklist – Packaging and Labelling of Imported Food

S. No.

Compliance Requirement

Responsibility / Action

1.

Proper transportation and storage

Ensure food is transported and stored under optimal temperature and hygiene conditions applicable to the particular food.

2.

Packaging and labelling compliance

Import only food that is packaged and labelled in accordance with applicable FSSAI regulations.

3.

Accessibility for inspection

Where multiple foods/food categories are packed in one container, carton, pallet or skid, pack them so that the Authorised Officer can easily access all articles for inspection and sampling.

4.

Stuffing list

Maintain a proper stuffing list for the imported food consignment.

5.

De-stuffing in absence of stuffing list

If no proper stuffing list is available, facilitate de-stuffing of the container as directed by the Authorised Officer to enable inspection and sampling.

6.

Permissible labelling rectification

For imported packaged food, specified rectifiable labelling deficiencies may be corrected at the customs-bound warehouse by affixing a single non-detachable sticker or through another non-detachable method next to the principal display panel.

7.

Particulars permitted for rectification

The rectifiable particulars include: (a) importer’s name and address; (b) FSSAI logo and licence number; (c) Veg/Non-Veg logo; and (d) category/sub-category along with generic name, nature and composition for proprietary food.

8.

Rectification within specified time

Carry out permissible labelling corrections within the time specified by the Authorised Officer and within the customs area.

9.

Original label protection

Rectification must not alter or mask the original label information in any manner.

10.

Re-inspection after rectification

After rectification, the Authorised Officer shall conduct re-inspection. Sampling may proceed if the officer is satisfied and all other requirements are fulfilled.

11.

Failure to rectify

If permissible deficiencies are not rectified within the specified time, the Authorised Officer may refuse clearance and issue a Non-Conformance Report (NCR).

12.

Sample collection

Once compliance is established, the Authorised Officer/representative shall draw two parts of the food sample in the customs area in the presence of the Food Importer or Customs House Agent for testing.

13.

Additional information

If the Food Analyst requires additional information regarding ingredients or other parameters, provide the information with appropriate documentary evidence as directed by the Authorised Officer.

14.

Non-compliant labelling/packaging

Food consignments that do not comply with the applicable Labelling and Packaging Regulations may be rejected at visual inspection itself, without drawing a sample.
